Patents – Hungary

A European Patent is a patent issued in accordance with the Munich Conventionhu on the Grant of European Patents of 5 October 1973 (‘the Convention'). A European patent applicationhu may be filed directly with the European Patent Office (EPO) or, in Hungary, the Hungarian Intellectual Property Office.

The national approval of a European patent application consists of the following stages:

  1. The European patent application may be submitted to the Hungarian Intellectual Property Office in any of the languages specified in the Convention, provided the application has been drawn up in Hungarian or one of the official languages of the European Patent Office, it includes a reference to the European patent claim, and it contains information enabling the applicant to be identified or contacted. The application may be filed electronically.
  2. Once the European patent application is published, the Hungarian Intellectual Property Office will make its published content available for consultation and grant access to the entries of the European Patent Register relating to the European patent application.
  3. On publication of the European patent application, patent protection will be granted (temporarily) in Hungary once the Hungarian Intellectual Property Office officially notifies the submission of a Hungarian translation of the claims in the Official Gazette. It is published by the Hungarian Intellectual Property Office at the applicant's request, provided a Hungarian translation of the claims is available (for a fee, to be paid within two months) and the application meets the formal requirements. Failure to pay the fee or to rectify deficiencies will result automatically in the right being forfeited and the application being declared withdrawn.
  4. The Hungarian Intellectual Property Office will indicate in a separate register that temporary protection has been granted on publication of the European patent application. The register is public, it can be consulted by anyone.
