Most ASM are illiterate and they don't even know what a policy is. With this in mind they cannot develop a health and safety policy in there mining places. The best way will be to train them through ASM associations and cooperative on health and safety issues and make regular follow ups to ensure implementation.
The other thing is that mining department inspectorate should intensify extension services to regulate and make sure that best mining practices are adhered to and if they are not being followed the inspectorate should correct the problems on sight.
The mines department should also develop a health and safety policy that will be applicable to all ASM therefore before the ASM are given permission to start mining they should be oriented about the policy guidelines. This can help to enforce healthy and safety standards.

This is an activity in my Return to Work Plan (RWP) to senzitise ASM to légalisé their activities for a safety and secured mining sector.
In Malawi big and medium scale companies have either an EIA or an environmental management plan, and they have qualified people to make sure the environmental guidelines are being implemented and followed properly. This approach of having an EIA and EMP is the best and effective because it addresses the environmental challenges to some extent.
On the part of the ASM it a very big challenge because large part of it is unregulated and this group is very mobile as they don't usually stay at one place for long hence very difficult to track them. This makes it very difficult to monitor and regulate their activities if they are managing the environment well. Usually they don't have an EMP nor any knowledge about the environment.
The good approach for the ASM would be to organise them into collective groups like associations and cooperatives. the other thing would be to decentralise some powers to the local councils (assemblies) since it will be easier for them to monitor and regulate the ASM activities than the central government.
Training these miners through associations is the best solution to help protect the environment.
