EU citizens have the right to live in Portugal for up to 3 months without any conditions or formalities beyond holding a valid identity document (an identity card, citizen's card or passport).

The same applies to family members of an EU citizen who hold a valid passport and are accompanying or joining that person.

The EU citizen must carry at least one valid identity document as a means of identification if he or she is approached by the police authorities.

If that person cannot produce an identity document when requested to do so by the authorities, the following will be required:

  • A third party who must be able to provide proof of his or her identity must identify that person; the third party must produce proof of the EU citizen's identity; that person must accompany the third party to the place where these documents are kept.
  • If it is not possible to carry out these steps, the EU citizen will be taken to the nearest police station, where he or she will remain for the time strictly necessary for the authorities to establish his or her identity. This must not exceed 2 hours.

In Portugal, it is mandatory to carry an identity document. .

After spending 3 months in Portugal, EU citizens have 30 days in which to register, thereby formally establishing their right to live in the country. They are issed with a certificate registering them as EU citizens.
