FAQs - Permanent residence (>5 years) for non-EU family members

  • I came to live in Portugal with my French husband 6 years ago; my husband died 2 months ago, I have no independent income and I am on my own. Could the Portuguese authorities question my right to remain in Portugal?

NO – Your husband and you, irrespective of your nationality, acquired the right of permanent residence in Portugal after 5 years, and this right is no longer subject to any conditions, such as having ‘sufficient resources'.

  • During the 4 years I have lived in Portugal, I got seriously ill and left the country for 11 months to be treated in my home country. Will this affect the continuity of my residence in Portugal next year when I should get the right of permanent residence?

NO – The continuity of your residence in Portugal is not affected by one absence for a maximum of 12 consecutive months for important reasons such as serious illness.

  • I was issued a permanent residence card, and it is valid for 10 years. Do I have to re-apply for a residence card in 10 years' time?

YES – You have to apply again but your permanent residence card will be renewed without any further checks.
