Statement by Vice President Joaquín Almunia following General Court judgment in Case T-167/08 Microsoft vs Commission

"I welcome this important judgment by the General Court in the Microsoft case.

Today's judgment fully vindicates the enforcement action that the Commission took to ensure Microsoft's compliance with its obligations. The ruling confirms that Microsoft did not comply with the Commission's decision and that the Commission was right to impose a penalty, even though the Court chose to slightly reduce the amount of the penalty payment from 899 million euros to 860 million euros.

The requirement that Microsoft disclose information to its competitors so as to allow interoperability between the dominant Windows architecture and rival work group servers brought significant benefits to users. A range of innovative products that would otherwise not have seen the light of day were introduced on the market. The Commission's determination to enforce that requirement was instrumental in achieving that result.

The Commission remains fully committed to enforcing EU competition rules to ensure that consumers and businesses alike can benefit from innovative and interoperable products.

The judgment confirms that the imposition of such penalty payments remains an important tool at the Commission's disposal".
