Commission urges Poland to transpose provisions of directive on marketing of fodder plant seed mixtures

The European Commission asked Poland today to notify national implementing measures providing for certain derogations for marketing of fodder plant seed mixtures intended for use in the preservation of the natural environment as required by Directive 2010/60/EU.

Biodiversity and the conservation of species-rich grassland are important for specific regions as well as the EU as a whole in order to preserve the natural environment. Derogation from the normal rules was necessary as the components of those mixtures do not always comply with some of the general EU marketing rules for seeds, e.g. varietal identity and purity. Directive 2010/60/EU provides for less stringent rules, which are necessary to allow the marketing of fodder plant seed mixtures as 'preservation seed mixtures'. The new rules create business opportunities for the production and marketing of natural species rich seed mixtures for the purpose of e.g. landscaping.

Poland has not communicated the measures implementing this directive.

The Commission's request to Poland takes the form of a "reasoned opinion" under EU infringement procedures.

Earlier this year the Commission initiated the infringement procedure, described in Article 258 of the Treaty on the Functioning of the European Union (TFEU), by sending a letter of formal notice to Poland.

Since Poland continues not to comply with the Commission's request, a "Reasoned Opinion," is being sent to formally request its compliance within a period of two months. Subsequently, the Commission may decide to refer Poland to the EU's Court of Justice if action to ensure compliance is not taken.
