Inxejnu l-miti u l-limiti inviżibbli: tnedija tal-bażi tad-dejta ta' "Nisa Eliġibbli għall-Bordijiet"
Illum l-Inizjattiva Nisa Eliġibbli għall-Bordijiet tal-Iskejjel tal-Kummerċ Ewropej qed tittrasferixxi l-lista "Nisa Imħejjija għal fuq il-Bordijiet" li fiha 8,000 mara lejn bażi tad-dejta onlajn. Dawn jissodisfaw kriterji stretti għal Tmexxija Korporattiva, li ġew magħżulin minn kumpaniji elenkati kkwotati fil-Borża u huma kapaċi li jidħlu jaħdmu f'bordijiet immedjatament. Din il-lista, li dejjem qed titwal, ta' nisa "Imħejjija għall-Bordijiet" – li issa tista’ tiġi kkonsultata onlajn mill-korporattivi u kumpaniji li jfittxu postijiet eżekuttivi- tagħmilha ċara li hemm għadd kbir ta' nisa kkwalifikati sew biex jgħinu jiggwidaw id-dħul tal-korporazzjonijiet Ewropej u dinjin fis-Seklu 21, u li issa wasal iż-żmien li jintgħelbu l-ostakli li s'issa waqqfu lil dawn in-nisa milli jilħqu l-pożizzjonijiet f'bordijiet tad-diretturi.
"Irridu nutilizzaw it-talenti kollha tas-soċjetà tagħna biex niżguraw li tieħu spinta l-ekonomija Ewropea. Għalhekk jiena pproponejt liġi Ewropea li ġġib 'il quddiem bilanċ ta' sessi fis-swali tal-laqgħat tal-kumpaniji," qalet il-Viċi Presidenti Viviane Reding, il-Kummissarju tal-Ġustizzja tal-UE. "Ta' spiss nisma' l-argument li mhemmx biżżejjed nisa kkwalifikati biex jokkupaw il-pożizzjonijiet fil-kmamar tal-laqgħat tad-diretturi. Illum qegħdin ingiddbu l-miti, mhux biss infarrku l-ostakli inviżibbli li jżommu lura lin-nisa! Il-lista turi li jeżistu n-nisa kkwalifikati – hemm 8,000 minnhom. Il-kumpaniji issa jridu jutilizzaw dan il-talent li s'issa ma ġiex sfruttat."
Il-lista u l-forum tal-"Bażi tad-Dejta ta' Nisa li huma Eliġibbli għall-Bordijiet" li jistgħu jiġu kkonsultati se jkunu amministrati mill-Klabb tad-Diretturi mhux Eżekuttivi tal-Financial Times, fuq il-pjattaforma dinjija tal-kummerċ, LinkedIn. In-nisa kollha elenkati fil-bażi tad-dejta ta' Nisa minn madwar id-Dinja li huma Eliġibbli għall-Bordijiet jistgħu jiġu kkunsidrati għal pożizzjonijiet ta' livell ta' bord f'kumpaniji kkwotati fil-Borża u jissodisfaw sett ta' kriterji ċari li ġie żviluppat u ddefinit matul l-aħħar sena u nofs mill-membri tal-organizzazzjoni tal-inizjattiva tal-Iskejjel Ewropej tal-Kummerċ/Nisa f'Bordijiet (ara hawn taħt).
Kull applikazzjoni għall-parteċipazzjoni f'din il-bażi tad-dejta hija assessata u vvalutata formalment, u dawk in-nisa biss li jissodisfaw il-kriterji ġew aċċettati. Skejjel tal-Kummerċ u Organizzazzjonijiet Professjonali li qegħdin jieħdu sehem japplikaw l-istess kriterji għall-eks-studenti u l-Membri tagħhom li qegħdin jipparteċipaw.

Il-Kummissjoni Ewropea, f'Novembru 2012, ipproponiet leġiżlazzjoni li tinkoraġġixxi bilanċ tas-sessi fil-bordijiet tal-kumpaniji. Id-Direttiva proposta tistabbilixxi mira minima ta’ 40% sal-2020 għall-membri tas-sess li għandu rappreżentanza iżgħar għal membri mhux eżekuttivi tal-bordijiet ta’ kumpaniji kkwotati fil-Borża fl-Ewropa, jew sal-2018 għall-intrapriżi pubbliċi kkwotati fil-Borża.
Il-proposta tinkludi wkoll, bħala miżura komplementari, “kwota flexi”: obbligu għall-kumpaniji kkwotati fil-Borża li jistabbilixxu miri individwali, awtoregolatorji għalihom rigward ir-rappreżentanza taż-żewġ sessi fost id-diretturi ta’ bordijiet eżekuttivi li jridu jinkisbu sal-2020 (jew l-2018 fil-każ ta’ impriżi pubbliċi).
Il-kwalifiki u l-mertu se jibqgħu l-kriterji ewlenin għall-ħatra f'bord. Id-Direttiva proposta tistabbilixxi armonizzazzjoni minima ta' rekwiżiti għat-tmexxija korporattiva, minħabba li d-deċiżjonijiet dwar il-ħatriet iridu jkunu bbażati fuq kriterji oġġettivi ta' kwalifiki. Barra minn hekk, salvagwardji intrinsiċi se jassiguraw li ma jkunx hemm promozzjonijiet bla kundizzjonijiet u awtomatiċi tas-sess l-anqas irrappreżentat. Skont il-ġurisprudenza tal-Qorti tal-Ġustizzja Ewropea dwar l-azzjoni pożittiva, għandha tingħata preferenza lis-sess l-anqas irrappreżentat ugwalment ikkwalifikat, sakemm valutazzjoni oġġettiva li tikkunsidra l-kriterji speċifiċi kollha għall-kandidati individwali taqleb il-bilanċ favur il-kandidat tas-sess l-ieħor. L-Istati Membri se jkunu meħtieġa li jistabbilixxu sanzjonijiet xierqa u dissważivi għal kumpaniji bi ksur tad-Direttiva proposta.
Il-kompetenza tal-UE biex tilleġiżla f'materji ta' ugwaljanza bejn is-sessi tmur lura sal-1957 (ara SPEECH/12/702). Ir-Rakkomandazzjonijiet tal-Kunsill dwar il-promozzjoni tal-parteċipazzjoni bbilanċjata tan-nisa u l-irġiel fil-proċess tat-teħid tad-deċiżjonijiet tmur lura għall-1984 u l-1996. Barra minn hekk, il-Parlament Ewropew appella għal kwoti legalment vinkolanti fuq livell tal-UE f’bosta Riżoluzzjonijiet.
Rapport mill-Kummissjoni f'Marzu 2012 wera li madwar l-UE, il-bordijiet tal-kumpaniji fil-preżent huma ddominati minn sess wieħed. Hemm ukoll differenzi kbar bejn il-pajjiżi, fejn in-nisa jikkostitwixxu 27% tal-membri ta’ bordijiet fl-akbar kumpaniji Finlandiżi u 26% fil-Latvja, iżda biss 3% f'Malta u 4% f'Ċipru. Il-progress jidher biss fil-pajjiżi li introduċew liġijiet legalment vinkolanti għall-bordijiet tal-kumpaniji. Franza, li introduċiet kwota legali f'Jannar 2011, waħedha tgħodd għal aktar minn 40% tal-bidla totali mal-UE kollha rreġistrata bejn Ottubru 2010 u Jannar 2012.

Annex 2: The List of 8 000 Board Ready Women – Where They Come From
Business School Alumnae, Faculty and Board Members
1) London Business School has 330 Alumnae they have identified as Board Ready – 330.
2) Cambridge Judge Business School has identified 160 women from its networks who are either already on boards or board ready according to the criterion provided - 160.
3) EDHEC Business School has 300 Alumnae, Faculty and Board Members they have identified as board Ready – 300.
4) ESMT European School of Management and Technology ‐ Out of 24 women Executive MBA alumni from its three graduated Executive MBA classes, ESMT has identified 6 board ready women - 6.
5) IESE has identified 900 women in top executive positions, 155 of whom are on boards already and 300 of which are board ready currently and the rest will become board ready in the coming years – 455/900.
6) The IFPM Female Board Pool at the University of St.Gallen/Switzerland has identified 526 women who are Board ready (245 from their Female Board Pool Network and 281 women who work at the Board of Directors or Top Management Team level of Swiss companies) - 526.
7) IMD has identified amongst its alumni 348 board-ready women with more than 25 years of experience plus 12 senior Faculty – 360.
8) INSEAD has identified 2000 women - 67 of whom are on boards already 500 of which are currently board ready and the rest will become board ready in the coming years – 670/2000.
9) RSM (Rotterdam School of Management/Erasmus University) has identified 32 board ready women -150.
10) Bocconi Business School, Italy has identified 150 board-ready women amongst their alumnae and faculty – 150.
