Il-Kummissjoni tappella lill-Istati Membri biex ma jkunux stretti wisq meta jaġġornaw ir-regoli dwar it-TV fl-2009

Sena wara d-dħul fis-seħħ ta' Direttiva ġdida tal-UE intenzjonata għal-liberalizzazzjoni tar-regoli tat-TV u t-tneħħija ta' restrizzjonijiet burokratiċi li m'għadx hawn użu għalihom fir-rigward tal-forniment tat-TV diġitali fuq l-Internet, il-video on demand u t-TV fuq il-mowbajl fl-Ewropa, l-Istati Membri tal-UE ftit għamlu progress fl-adazzjoni tal-livelli nazzjonali. Ir-Rumanija biss implimentat b'mod komprensiv ir-regoli ġodda tal-UE dwar il-midja awdjoviżiva li daħlu fis-seħħ fid-19 ta' Diċembru 2007 (IP/07/1809). Id-Direttiva tal-UE dwar is-Servizzi Awdjoviżivi tal-Midja, adottata mill-Parlament Ewropew u mill-Kunsill tal-Ministri tal-UE fuq proposta mill-Kummissjoni (IP/05/1573) fasslu mill-ġdid ir-regoli l-qodma tal-UE dwar ix-xandir tradizzjonali tat-TV u l-ġenerazzjoni l-ġdida tagħha tas-servizzi li jixbħu t-TV. Is-26 Stat Membru l-oħra bħalissa qed idaħħlu r-regoli modernizzati għall-industrija awdjoviżiva tal-UE fil-liġi nazzjonali tagħhom. Għandhom sa Diċembru 2009. Sa dak iż-żmien l-UE missha jkollha suq uniku għas-servizzi kollha Awdjoviżivi tal-Midja, li jipprovdu ċertezza legali għan-negozji u pprogrammar aktar varjat u ta' kwalità aħjar għall-ispettaturi.

"Ir-regoli l-ġodda tal-UE huma opportunità biex jinħoloq suq uniku għall-era diġitali, u jiena nħeġġeġ lill-Istati Membri biex idaħħluhom malajr u b'mod flessibbli sabiex il-produtturi tat-TV, ix-xandara u l-ispettaturi jibdew jibbenefikaw minnhom malajr kemm jista' jkun ,"qalet Viviane Reding, Il-Kummissarju tal-UE għas-Soċjetà tal-Informazzjoni u tal-Midja. "Aġġornajna r-regoli tal-UE dwar it-TV minħabba teknoloġija li qed tinbidel malajr u minħabba l-ħtieġa li tissaħħaħ il-kompetittività tal-industrija awdjoviżiva tal-UE. Għall-Istati Membri, dan jirrappreżenta opportunità biex jitneħħew ir-restrizzjonijiet li m'għadx hawn użu għalihom, biex jissaħħu l-koregolazzjoni u l-awtoregolazzjoni, speċjalment fir-reklamar, biex jissaħħaħ id-dritt għall-informazzjoni, u biex jiġu promossi l-kwalità u d-diversità. Madankollu jiena ninsab mħassba li ċerti Stati Membri donnhom qed jinterpretaw ir-regoli ġodda bħala skuża biex iżidu aktar burokrazija. Ħloqna regolamentazzjoni aħjar fil-livell tal-UE għas-settur awdjoviżiv, u nistenna li l-Istati Membri jagħmlu l-istess fil-livell nazzjonali."

F'nofs triq fil-perjodu ta' sentejn li l-Istati Membri ngħataw biex idaħħlu r-regoli l-ġodda tal-UE dwar it-TV u s-servizzi li jixbħu t-TV bħal video on demand u video fuq il-mowbajl, ir-Rumanija biss diġà implimentat id-Direttiva tas-Servizzi Awdjoviżivi tal-Midja fil-leġiżlazzjoni nazzjonali tagħha (għal tagħrif dwar il-qagħda fis-27 Stat Membru kollha, ara l-anness).

Fil-25 ta’ Novembru, ir-Rumanija adottat digiret tal-Gvern ġdid li jemenda l-liġi Awdjoviżiva tal-2002 biex isir it-tibdil li hemm fid-Direttiva l-ġdida tal-UE. Ir-Rumanija għamlet użu mill-alternattivi kollha ta' liberalizzazzjoni li d-Direttiva toffri, inkluż it-turija ta’ prodotti. Malli tkun innotifikata uffiċjalment b’dawn l-emendi, il-Kummissjoni se tivverifika jekk iwettqux bis-sħiħ id-Direttiva tal-UE tal-2007.

Is-26 Stat Membru l-oħra tal-UE kif ukoll il-pajjiżżi taż-Żona Ekonomika Ewropea (l-Iżlanda, in-Norveġja, Liechtenstein) u l-pajjiżi kandidati (il-Kroazja, l-eks Repubblika Jugoslava tal-Maċedonja u t-Turkija) għadhom fil-proċess li jdaħħlu r-regoli l-ġodda. Madankollu, il-progress miexi bil-mod f'ħafna mill-Istati Membri: xi gvernijiet għadhom ma għamlux konsultazzjonijiet pubbliċi dwar kif ir-regoli tal-UE se jaħdmu f'pajjiżhom (il-Bulgarija, id-Danimark, il-Ġermanja, il-Greċja, l-Italja, is-Slovenja, is-Slovakkja u Spanja). F'ċerti Stati Membri, abbozzi tar-regoli l-ġodda jinsabu lesti għal proċeduri parlamentari fil-bidu tas-sena d-dieħla (il-Belgju, ir-Repubblika Ċeka, il-Finlandja, l-Irlanda, il-Latvja, l-Olanda u l-Portugall).

Il-Lussemburgu ddikjara li diġà implimenta wħud mir-regoli l-ġodda, notevolment dawk relatati mar-reklamar. L-Awstrija għandha ssegwi f'Jannar. L-Awstrija wkoll kienet l-ewwel pajjiż li ppermettiet ir-reklamar mistur permezz tat-turija ta‘ prodotti (product placement), f'konformità mar-regoli tad-Direttiva l-ġdida u bil-kundizzjoni li l-konsumaturi jiġu infurmati biċ-ċar. Fi Franza, ix-xahar li għadda ġie ppreżentat abbozz ta' liġi lill-Assemblea Nazzjonali. Il-liġi riveduta tista' tiġi adottata miż-żewġ kmamar tal-parlament Franċiż fil-bidu tas-sena d-dieħla. L-abbozz tal-liġi Franċiża jagħti lir-regolatur indipendenti (Conseil Supérieur de l'Audiovisuel) is-setgħa li jirregola t-turija tal-prodotti.

Ir-regoli l-ġodda tal-UE jagħmilha aktar faċli għall-produtturi u l-fornituri tal-programmi tat-TV biex ikollhom aċċess għal finanzjament minn forom ġodda ta' reklamar awdjoviżiv bħal reklamar split screen jew it-turija tal-prodotti, li jitħalla jsir fil-programmi kollha ħlief fl-aħbarijiet, fid-dokumentarji u fil-programmi tat-tfal. Ix-xandara jistgħu wkoll jinterrompu l-programmi aktar faċilment bis-saħħa tat-tneħħija tar-regola li timponi perjodu ta' għoxrin minuta bejn kull brejk għar-reklami. Ir-regoli l-ġodda tal-UE jimmiraw għat-tisħiħ tal-industrija tat-TV u awdjoviżiva tal-Ewropa billi jnaqqsu r-regolamentazzjoni u joħolqu ambjent ekwu għas-servizzi Awdjoviżivi tal-Midja "mingħajr fruntieri"..

Sfond

Fit-13 ta' Diċembru 2005, il-Kummissjoni pproponiet li ssir reviżjoni tad-Direttiva "Televixin Mingħajr Fruntieri" sabiex jiġu indirizzati żviluppi teknoloġiċi u żviluppi sinifikanti tas-suq fis-settur tas-servizzi awdjoviżivi (IP/05/1573, MEMO/06/208). Fid-9 ta' Marzu 2007 l-Kummissjoni adottat proposta aġġornata għal abbozz modernizzat tad-Direttiva dwar is-Servizzi Awdjoviżivi tal-Midja (IP/07/311) sabiex tħejji t-triq għal dan il-ftehim bikri tat-tieni qari tagħha mill-Parlament u mill-Kunsill (MEMO/07/206). Il-Parlament Ewropew approva l-pożizzjoni komuni tal-Kunsill u d-Direttiva daħlet fis-seħħ fit-18 ta' Diċembru 2007.
