Maritime safety: prevention of pollution from ships

European Union legislation on maritime safety must be adapted at regular intervals to take account of the amendments or the protocols to the international conventions, new resolutions or changes to the codes and compendia of existing technical rules.

ACT

Directive 2002/84/EC of the European Parliament and of the Council of 5 November 2002 amending the Directives on maritime safety and the prevention of pollution from ships.

SUMMARY

This Directive aims to improve the implementation of European Union (EU) legislation on maritime safety, on the prevention of pollution from ships and on shipboard living and working conditions.

The Directive is closely linked to Regulation EC No 2002/2099 establishing a Committee on Safe Seas and the Prevention of Pollution from Ships and amending the Regulations on maritime safety and the prevention of pollution from ships. The aim is to simplify the committee procedures through the replacement of the various committees set up under the EU legislation on maritime safety and the prevention of pollution from ships with a single committee.

At the same time, the Directive seeks to speed up and simplify the incorporation of international rules into EU legislation.

This Regulation amends Council Directive 97/70/EC setting up a harmonised safety regime for fishing vessels of 24 metres in length and over and Council Directive 1999/35/EC on a system of mandatory surveys for the safe operation of regular roll-on/roll-off (ro-ro) ferry and high-speed passenger craft services with regard to the regulatory procedure with scrutiny. Regulation (EC) No 219/2009 confers scrutiny rights on the Council and the European Parliament with regard to rules in a range of policy fields, including environment and transport.
