Statutory markings for two- or three-wheel motor vehicles

This Directive is aimed at approximating the laws of the Member States in the field of statutory markings applying to two- or three-wheel motor vehicles.

ACT

Directive 2009/139/EC of the European Parliament and of the Council of 25 November 2009 on statutory markings for two- or three-wheel motor vehicles (Text with EEA relevance).

SUMMARY

This Directive defines the statutory markings which must appear on two- or three-wheel motor vehicles.

It concerns the following vehicles:

  • mopeds: two- or three-wheel vehicles fitted with an engine not exceeding 50 cm3 and a maximum speed of not more than 45 km/h;
  • motorcycles: two-wheel vehicles fitted with an engine exceeding 50 cm3 and a maximum speed of more than 45 km/h;
  • motor tricycles: three-wheel vehicles fitted with an engine exceeding 50 cm3 and a maximum speed of more than 45 km/h;
  • quadricycles: vehicles with an unladen mass of less than 350 kg, a maximum speed of 45 km/h or less and an engine power of 50 cm3 or 4 kw or less.

Requirements concerning statutory markings

All vehicles must receive a plate and markings affixed by the manufacturer or the authorised representative.

The data plate must contain the following information:

  • name of manufacturer;
  • type-approval mark;
  • vehicle identification number (VIN) consisting of a structured combination of characters (Latin letters and numerals);
  • stationary sound level.

Two or three-wheel motor vehicles must have obtained EC type-approval in respect of the statutory markings before they can be placed on the market. The procedures for the granting of EC type-approval * are laid down by the Directive relating to EC type-approval procedures.

Member States may not prohibit the registration of vehicles which comply with this Directive.

This Directive repeals Directive 93/94/EC.

Key terms of the Act

  • type-approval: the procedure whereby a Member State certifies that a type of vehicle, system, separate technical unit or component satisfies the technical requirements set out in Directive 2002/24/EC or the separate directives, and the checks on the correctness of the manufacturer's data.
